Terms and Conditions

Ishvara Tech Consulting Pvt Ltd

Effective date: 15 October 2026
Last updated: 15 October 2026

1 About these terms

These Terms and Conditions govern your use of https://ishvaratechconsulting.com and its public pages, enquiry forms, downloadable materials and links to meeting bookings (the “Website”). The Website is operated by Ishvara Tech Consulting Pvt Ltd (“Ishvara”, “we”, “us” or “our”), an Indian company based in Bhubaneswar, Odisha.

Please read these Terms before using the Website. They apply to your use to the extent permitted by law. Where an action requires express agreement, we will ask for it separately. If you do not agree to these Terms, please stop using the Website. Our Privacy Policy explains how we handle personal information; acceptance of these Terms is not consent to every activity described in that policy.

2 Who may use the Website

You may browse the Website for lawful purposes. To submit a business enquiry, book a consultation or enter into a service engagement, you must be at least 18 years old and legally able to enter into the relevant arrangement. If you act for an organisation, you must have authority to do so. You must provide accurate information and avoid impersonating another person or organisation.

3 Our services and separate agreements

The Website describes our technology consulting and delivery capabilities, including:

  • Application services, including custom web, SaaS and mobile application development.
  • AI and machine learning services, including AI avatars, speech and text solutions, data analytics and natural language processing.
  • Infrastructure and cloud consulting for AWS, Microsoft Azure and Google Cloud.
  • Creative design, user interface design and user experience design.
  • Automation, manual, performance and load, API and security testing.

Service descriptions, examples, technologies and indicative outcomes are provided to help you assess our capabilities. A Website enquiry, meeting booking or introductory discussion does not by itself appoint us, reserve a delivery team or establish a paid project.

Each engagement requires a separate agreement, accepted proposal, statement of work or order that identifies the contracting parties and the agreed scope. That agreement governs deliverables, pricing, taxes, payment, timelines, dependencies, acceptance, support, service levels, confidentiality, data processing, intellectual property, termination and refunds. It prevails over these Website Terms for that engagement if there is a conflict. Mandatory legal rights remain unaffected.

4 Enquiries and consultation bookings

When you contact us or book a meeting, provide only information relevant to your request. Bookings made through Calendly are also subject to Calendly’s applicable participant terms and privacy notice. Please check your time zone, meeting details and any cancellation or rescheduling instructions in the booking confirmation.

We may need to reschedule or decline a meeting because of availability, an unsuitable request or misuse. Any fee for a consultation will be disclosed and agreed before it becomes payable. Booking an introductory meeting does not guarantee a particular recommendation, commercial result or project acceptance.

An initial enquiry does not itself establish a non-disclosure agreement. Please arrange appropriate confidentiality terms and a secure transfer method before sharing proprietary code, production credentials, confidential datasets or other sensitive material. We will handle personal information in accordance with our Privacy Policy and applicable law.

5 Acceptable use

You must not use the Website to:

  • Break the law, infringe intellectual property or privacy rights, or submit material that you are not authorised to share.
  • Send malicious code, phishing messages, spam, deceptive enquiries or abusive content.
  • Obtain unauthorised access to the Website, its accounts, infrastructure or connected systems, or bypass security or access restrictions.
  • Run penetration tests, vulnerability scans, load tests or other disruptive automated activity without our prior written authorisation.
  • Extract personal information or restricted content, or use automated access in a way that violates applicable law or materially disrupts the Website.
  • Misrepresent an affiliation with Ishvara or use our name, branding or content to imply an endorsement we have not given.

These restrictions do not prevent activity that applicable law expressly permits and that cannot lawfully be restricted by contract.

6 Website content and intellectual property

The Website’s original text, layouts, graphics, designs, code and branding belong to Ishvara or its licensors and are protected by applicable intellectual property laws. You may view the Website and retain reasonable copies for your own internal evaluation, provided you preserve ownership notices.

Except where permitted by law or expressly authorised in writing, you may not reproduce, republish, sell, distribute or commercially exploit our Website content. Third-party names, logos and marks belong to their respective owners. Their appearance does not by itself establish a partnership, certification or endorsement.

Ownership and licensing of client deliverables, source code, design files, models, reusable components and third-party assets are determined by the relevant service agreement and applicable licences. Website access does not transfer those rights.

7 Materials you provide

You retain your rights in materials you submit. You authorise us to use them only as reasonably needed to review and respond to your request, perform an agreed engagement, or comply with law. Personal information remains subject to the Privacy Policy and applicable data protection requirements.

You must have the necessary rights, permissions and lawful grounds to provide any personal information, datasets, recordings, brand assets or other materials belonging to another person. Submission does not grant us a general right to publish your material, use it in a portfolio or train an AI model. Those uses require an appropriate separate arrangement and any permissions required by law.

8 AI systems and generated outputs

AI-generated text, code, designs, transcriptions, predictions and other outputs can contain errors, omissions, bias or material similar to other outputs. You should review relevant outputs before using them, particularly where they affect people, legal obligations, security or important business decisions.

Unless expressly agreed in a service contract, a demonstration or description of AI capabilities is not a promise of error-free operation, exclusive ownership of every generated element or a specific business result. Rights in AI outputs may depend on applicable law, the input materials and third-party model or tool terms.

For avatar, speech or likeness projects, the agreed scope must identify the permitted use and the necessary permissions from the person represented or another lawful rights holder. Our Website does not authorise impersonation, misleading synthetic media or use of another person’s identity without a lawful basis.

9 Cloud services and external platforms

Cloud providers, model providers, software libraries, app stores and external platforms operate under their own terms, usage limits and availability commitments. A reference to AWS, Azure, Google Cloud or another technology describes a capability; it does not mean that provider hosts this Website or is a party to your contract with us.

For an engagement, responsibility for subscriptions, usage charges, infrastructure access, backups, security configuration, licences and third-party changes must be agreed in the service agreement. Any Website link to an external service is provided for convenience. Review the relevant provider’s terms and privacy notice before using it.

10 Testing and security engagements

Security assessments, API tests and performance or load tests require prior written authorisation from the owner or lawful controller of every system in scope. A separate engagement must define the permitted targets, methods, timing, limits and handling of findings and test data. Permission to test one system does not extend to another provider’s systems.

Testing findings reflect the agreed scope, available information and conditions at the time of testing. An assessment cannot guarantee that a system has no vulnerabilities, will never fail or automatically complies with every legal or industry requirement. Any agreed testing warranties or remediation obligations remain governed by the service agreement.

11 Privacy and communications

Our Privacy Policy explains the information collected through the Website and business enquiry process, its purposes, relevant sharing and available choices. Please read it before sending personal information.

We may contact you to respond to your enquiry, manage a meeting or discuss an engagement you requested. Promotional communications require a separate lawful basis and, where required, your consent. You may opt out of marketing using the instructions in the message or by emailing us.

12 Website availability and information

We aim to keep the Website useful and accurate, but its content and availability may change. To the extent permitted by law, the Website and its general information are provided on an “as available” basis without a promise of uninterrupted access, complete accuracy or suitability for a particular purpose.

Examples, testimonials, case studies and performance statements describe particular circumstances. They do not guarantee the same outcome for another project. You should confirm current scope, availability, pricing and contractual commitments directly with us before relying on them.

13 Liability and mandatory rights

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising solely from use of, or inability to access, the public Website, including lost business opportunities or anticipated profits. Liability for professional services is governed by the relevant service agreement and applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. These Terms do not remove mandatory consumer remedies or obligations and remedies under applicable privacy and data protection law.

14 Restricting access

We may restrict or suspend access where reasonably necessary to address unlawful activity, a material breach of these Terms, a security threat, maintenance or a legal requirement. Where practical and appropriate, we will give notice. Restriction of Website access does not by itself terminate a separate client agreement or remove your privacy rights.

15 Changes to these Terms

We may update these Terms to reflect changes to the Website, our business or applicable law. The updated version will show a revised date and apply prospectively from the stated effective date. We will provide additional notice or seek express agreement where required. An update to these Website Terms does not automatically amend an existing service agreement.

16 Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory law that gives you a right to another court, consumer forum or authority, the competent courts at Bhubaneswar, Odisha, India will have jurisdiction over disputes concerning these Website Terms.

Please contact us so that we can first try to resolve a concern. This does not prevent either party from seeking urgent relief or exercising a right within a statutory time limit. Any dispute clause in a separate service agreement applies to disputes under that agreement.

17 General provisions

If a provision is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive it. These Terms govern the public Website and do not create an agency, employment, joint venture or partnership relationship between you and Ishvara.
